Finally A Good Decision

Thank goodness there was a good outcome in this lawsuit because it would have been a disgrace to all lawyers and the justice system if the outcome would have been bad...
simmons jannace & stagg were asked by a widow to represent her because an attorney she had had for the Victims Compensation Fund charged her $2,000,000 for a contingency fee!! He filed a suit in a federal court stating a declaratory judgement that entitled him to that fee. And Simmons, Jannace and Stagg argued to dismiss the federal action. They argued that the Victims Compensation Fund didn’t give the federal jurisdiction for any action by any attorney seeding to protect HIS fee. They also noted that there was no reported case such as an exorbitant fee for representation before this Victims Compensation Fund.

The size of the fee is obviously ridiculous - trying to take someone elses money for their lost one. The federal court agreed thank goodness. This is the first federal court decision with attorneys’ fee disputes that have occured out of the September 11th Victims Compensation Fund that really should be litigated in the state courts
